Baseline Environmental Assessment

Protecting purchasers and users of real estate from liability for existing contamination, at the time of a real estate transaction, is a valuable service and an integral part of the property transfer process in the State of Michigan.

Under the Michigan Natural Resources and Environmental Protection Act, 1994, Part 201, as amended, a new owner of a property that is contaminated can submit a BEA, establishing an exemption from existing contamination. The BEA is submitted to the Michigan Department of Environmental Quality (MDEQ) following an All Appropriate Inquiry ESA in compliance with 40 CFR Part 312 or Phase I ESA in compliance with the ASTM E1527-13 Standard and a Phase II ESA establishing that the site is contaminated, within 45 days of acquiring the property.
